TERMS OF SERVICE
This terms of service agreement (together with any document incorporated herein by reference, the “Agreement“) is between you and Maid Of New York, Inc. (“Maid Of New York” or “us” or “we“) and governs your use of the Maid Of New York website(s) (“Site“), and the services we provide to you (“Services“), including via the web browsers (e.g., mobile websites, smartphone mobile or tablet applications) of the Maid Of New York services. If you do not agree with all of the provisions of this agreement, then do not access and/or use the website or the services.
Maid Of New York, Inc. reserves the right, at any time, to modify the Maid Of New York content (as defined below in the conditions of use), the service, or any part thereof with or without notice.
By using the Maid Of New York website, you represent and warrant that: (a) you are at least 18 years old, are at least of the legally required age in the jurisdiction in which you reside, and are otherwise capable of entering into binding contracts; and (b) you have the right, authority and capacity to enter into this agreement and to abide by the terms and conditions of this agreement, and that you will so abide. Where you enter into this agreement on behalf of a company or other organization, you represent and warrant that you have the authority to act on behalf of that entity and to bind that entity to this agreement.

Our goal is to deliver the most amazing cleaning experience in your home. We are so confident you’ll love our service we offer a 100% guarantee. If you are not completely satisfied, contact us within 24 hours, and we’ll come back and make it right. Any re-cleans will be done if notified within 24 hours of the service appointment. Any re-cleans can only be done with the same team and only within the first 24 hours of the initial cleaning. If you do not want the same team to come, you will be charged a fee for another team to come out.
BILLING AND REFUNDS
In agreeing to receive service from Maid Of New York, as witnessed by your subsequent request for service, you do so with the understanding (i) that receiving service at a flat-rate pricing structure established by Maid Of New York shall be viewed and billed as simply “time & labor”; and (ii) that once “time & labor” has been extended to you that neither discounts, credits or refunds shall be available to you from either Maid Of New York or the financial institution through which you have provided payment; and (iii) that you authorize and acknowledge Maid Of New York right to charge your account and card any and all applicable fees, fines and penalties as allowed for during the servicing of your account.
CLEANING TYPE AND ESTIMATED TIME
Your clean may take more or less time than estimated. On the day of service, your team will give you a more accurate estimated time based on the condition of your home. Additional time is added if extras are selected when booking. Suppose the condition of your home does not fit under our recommended cleans. Maid Of New York reserves the right to amend its services from flat-rate pricing to a customized rate of $1.50 per square footage.
HOME SIZE AND TYPE
We offer Studio, 1, 2, 3, and 4 bedrooms with up to 4 baths in sizing for apartments. For larger homes, custom jobs, private houses, loft, duplex, brownstone, and townhouse. Our customize service rate is $1.50 per square footage for larger homes. Maid Of New York reserves the right to amend its services from flat-rate pricing to a customized rate if your home does not fit our home guidelines in sizing.
RIGHT TO REFUSE SERVICE
Our team has the choice to leave upon arrival if the home is in extreme condition or feels unsafe/threatened. The team may refuse service on the spot, and you will be charged the maximum cancellation fee of $49.
RATE CHANGES AND ADDITIONAL CHARGES
Maid Of New York reserves the right to amend its rates at any time to allow for business-related cost increases. Suppose the condition of your home does not fit under our recommended cleans or average home guidelines in sizing. Our service pricing will amend from flat-rate pricing to customize hourly rate in pricing.
CANCELLATIONS AND RESCHEDULES
Once your appointment for service has been solidified on our schedule, we set that space aside specifically FOR YOU. We also reserve the necessary team to attend to your cleaning while turning other business and potential customers away. Should you need to either cancel or reschedule a particular cleaning, we require a TWENTY FOUR HOURS ADVANCE NOTICE prior to your appointment.
LATE CANCELLATIONS & RESCHEDULING FEE
Customers failing to provide Maid Of New York the courtesy of a TWENTY FOUR HOURS notice of cancellation or rescheduling will have their account assessed a $49 late cancellation or rescheduling fee.
SHORT NOTICE CANCELLATION FEE
Because we reserve a time specifically for you while turning potential customers and business away, any cancellations less than 2 hours before your appointment scheduled time will be considered as service rendered. We will not be able to issue any refund for services.
LOCK-OUTS AND MISSED APPOINTMENTS FEE
If our team is either turned away at your door or simply unable to gain access to your home upon their arrival, an attempt will be made to contact you for assistance. If you cannot be reached or you refuse service, the team will be instructed to cancel the cleaning & move on to the next customer. Such a scenario shall be viewed as a “Lockout/Missed Appointment.” All Lockouts and missed appointments are treated as service rendered, and we will not issue any refunds for lock-outs and missed appointments.
RESCHEDULING/SKIPPING OF SERVICE (recurring service customers)
If you are a recurring customer, a discount has been factored into the price of your cleaning based on your frequency of service. If we are to honor the discounted pricing provided, we will require that you, in turn, honor the integrity of your recurring service schedule. In the event you cannot maintain the integrity of your scheduled appointment and you need to skip a cleaning (as opposed to rescheduling), your next appointment for service will be billed as full price in order to bring the home back up to recurring maintenance level. If you would like to reschedule your scheduled recurring appointment, you may do so TWENTY FOUR HOURS before your appointment at no additional cost. However, It is expected of you to honor your next upcoming scheduled appointment.
SUPPLIES & EQUIPMENT
Maid Of New York provide its own eco-friendly cleaning supplies and equipment. Should you need us to use your own chemicals and/or equipment, please let us know. With that said, neither Maid Of New York management nor the team will be held liable for equipment malfunction or property damage resulting from the use of your own personal equipment, supplies, or chemicals. As a standing policy, our team is under instructions not to use bleach or bleaching agents. Should you require, instruct and/or provide for use any bleach or bleaching agent or any other chemical not so approved or supplied by Maid Of New York, you do so fully aware that neither Maid Of New York management, the team, nor the insurance provider shall be held liable for any harm, damage or claims arising out of its use. Additionally, although the team will do their best when asked to make use of someone else’s equipment & supplies, management cannot extend a service guarantee on the quality of the cleanings provided in the event we are asked to make use of the equipment and/or supplies other than our own.
DAMAGES OR BREAKAGES
Although each Maid Of New York maid is trained to exercise the utmost care and caution when cleaning, accidents do occur from time to time. When damage/breakage occurs, employees are instructed to fill out an “Accident Report,” after which point someone from our management staff will contact you. Please be aware: There are times when breakages occur due to “booby-trapped” conditions. These are accidental breakages waiting to happen. Examples would be: pictures not fastened or hung securely, top-heavy items with unstable bases, wobbly objects, and/or previously damaged or fragile items. In light of such circumstances, Maid Of New York cannot take responsibility for accidents resulting from “booby-trapped” conditions. PLEASE NOTE: antiques, irreplaceable one-of-a-kind, and hard-to-find items are not covered by our insurance carrier’s breakage and loss policy (which means that in the event of damage/breakage, the cost of repair/replacement IS NOT COVERED OR REIMBURSABLE). Items of extreme value (monetary or sentimental) should be cleaned by the customer and/or moved to a safe location on the day of the cleaning.
DENIAL OF PAYMENT, CHARGE-BACKS, AND LATE FEES
Customers who have denied payment to Maid Of New York, Inc. by means of an intentional charge-back to their card will be assessed a $79 “denial-of-payment” fee in addition to all applicable late payment penalties, interest, administrative and collection costs. Late payment penalties are as follows: $49 for account balances carried seven days beyond the date of service, $59 additional if carried thirty days beyond the date of service.
Irrespective of any personal, financial, or service-related issues which may prompt you to terminate or temporarily suspend services provided by Maid Of New York, payment of all monies owed by you to Maid Of New York for time & labor previously rendered will still be required, with all terms and conditions remaining in full effect until all account balances have been paid in full. Withholding of any monies owed by you to Maid Of New York shall be met with all applicable fees, penalties, fines, and court action as allowed and governed by the terms and conditions of this agreement, with you bearing the full financial responsibility for all of Maid Of New York court, attorney(s), administration, collection and/or arbitration costs.
SOLICITATION OF EMPLOYEES
When hired, Maid Of New York employees signs a non-compete agreement barring them from performing any service for any past, present or prospective clients residing within our current service coverage area both during their employment and for a period of one full year following their departure or dismissal. Upon requesting service, all clients agree not to solicit, entice, or influence any current or previous employee still bound by their non-compete agreement to take care of their service needs, whether directly or indirectly, individually, or through a family member or other person or company, under penalty of a $6,500 finder’s fee assessed against their account, due & payable 30 days from the date of assessment. If you would like to hire, directly or indirectly, one of our current or previous employees who remain contractually obligated to their non-compete agreement, we would be happy to release them from their contract and bill your account a referral fee of $3,500. We consider our employees our most valuable asset and charge accordingly.
Communications between you and Maid Of New York shall include the use of electronic means, whether you visit our website or send us emails or text messages, or whether Maid Of New York posts notices on their website or communicates with you via email or text message. For contractual purposes, you (a) consent to receive communications from Maid Of New York in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that Maid Of New York provides to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. The foregoing does not affect your non-waivable rights.
If any provision of this agreement is, for any reason, held to be invalid or unenforceable, the other provisions of this agreement will be unimpaired, and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law. You may not assign, by operation of law or otherwise, any of its rights or delegate any of its duties under this agreement to any third party without Maid Of New York’s prior written consent. Any assignment, delegation, or transfer in violation of the foregoing will be null and void.
