Welcome to the terms of service agreement (referred to as the “Agreement”) between you and Maid Of New York, Inc. (“Maid Of New York” or “us” or “we”). This Agreement governs your use of the Maid Of New York website(s) (referred to as the “Site”) and the services we provide to you (referred to as the “Services”), including through web browsers (e.g., mobile websites, smartphone mobile or tablet applications). If you do not agree with all of the provisions of this agreement, please refrain from accessing and/or using the website or the services.
Maid Of New York, Inc. reserves the right to modify the Maid Of New York content (as defined below in the conditions of use), the service, or any part thereof at any time, with or without prior notice.
By accessing the Maid Of New York website, you confirm and guarantee that: (a) you are at least 18 years old, meet the minimum age requirement in your jurisdiction, and are legally capable of entering into binding agreements; and (b) you possess the necessary rights, authority, and capacity to enter into and comply with this agreement, and you commit to doing so. If you are entering into this agreement on behalf of a company or another organization, you assert that you have the authority to represent that entity and to bind it to this agreement.
Our mission is to provide an exceptional cleaning experience for your home. We are incredibly confident that you will be delighted with our service, which is why we proudly offer a 100% satisfaction guarantee. If for any reason you are not entirely happy, simply reach out to us within 24 hours, and we will promptly return to make things right. Any re-cleaning requests must be communicated within 24 hours of the initial service appointment and will be performed by the same team within this time frame. Should you prefer a different team for the re-cleaning, a nominal fee will apply.
BILLING AND REFUNDS
By requesting and receiving services from Maid Of New York, you acknowledge and agree to the following terms:
(i) Service will be charged at a flat-rate pricing structure established by Maid Of New York, representing “time & labor.”
(ii) Once services have been rendered, Maid Of New York and the financial institution through which payment was made will not provide discounts, credits, or refunds.
(iii) You authorize Maid Of New York to charge your account and card for any applicable fees, fines, and penalties incurred during the servicing of your account.
CLEANING TYPE AND ESTIMATED TIME
The duration of your cleaning service may vary from the initial estimate. On the day of the scheduled service, our team will provide a more precise estimate based on the specific condition of your home. If additional services are selected at the time of booking, extra time will be factored in accordingly. In the event that your home’s condition requires a level of service beyond our standard offerings, Maid Of New York reserves the right to adjust pricing from a flat rate to a customized rate of $99 per hour.
HOME SIZE AND TYPE
We provide a range of living spaces including studios, one, two, three, and four-bedroom apartments, each with up to four bathrooms. Additionally, we offer custom options for larger homes, private houses, lofts, duplexes, brownstones, and townhouses. Our customized service rate for larger homes is $99 per hour. Please note that if your home does not fit our standard guidelines, we reserve the right to adjust our pricing from a flat rate to a customized rate.
RIGHT TO REFUSE SERVICE
Upon arrival, if the home is found to be in an extreme condition or if our team feels unsafe or threatened, they reserve the right to refuse service. In such cases, a maximum cancellation fee of $59 will be applicable.
RATE CHANGES AND ADDITIONAL CHARGES
Maid Of New York reserves the right to adjust its rates in response to business-related cost increases at any time. If your home’s condition does not align with our recommended cleaning standards or falls outside the typical size range for an average home, our service pricing will be adjusted from a flat-rate to a customized hourly rate.
CANCELLATIONS AND RESCHEDULES
Once we’ve confirmed your service appointment, we dedicate that time exclusively to you, reserving the required team to ensure your cleaning needs are met. This means we prioritize your appointment over others, including potential new customers. If you need to cancel or reschedule, we kindly ask for a minimum of 24 hours notice before your scheduled appointment.
SAME-DAY CANCELLATION & RESCHEDULING
We kindly ask that customers provide Maid Of New York with a minimum of twenty-four hours notice for any scheduling changes. For cancellations or rescheduling within 24 to 2 hours before the appointment, a $59 fee will be applied to cover same-day changes.
SHORT NOTICE CANCELLATION
In order to provide you with dedicated attention and accommodate your appointment, we allocate a specific time slot for your visit, often turning away potential customers and business opportunities. Therefore, any cancellations made less than 2 hours before your scheduled appointment will be considered as though the service has been provided, and regrettably, we will be unable to issue refunds for such late cancellations.
LOCK-OUTS AND MISSED APPOINTMENTS
In the event that our team is unable to access your home upon their arrival, we will make every effort to contact you for assistance. If we are unable to reach you or if you decline service, our team will be directed to cancel the cleaning and proceed to the next customer. This situation will be considered a “Lockout/Missed Appointment.” Please note that all lockouts and missed appointments are considered as services rendered, and therefore, we are unable to issue refunds for such occurrences.
CANCELLING/SKIPPING OF SERVICE (recurring service customers)
As a valued recurring customer, we’ve included a special discount on the price of your cleaning based on how often you use our service. To continue receiving this discounted rate, we kindly ask that you maintain the regularity of your scheduled cleanings. If, for any reason, you need to skip a cleaning and cannot uphold your recurring service schedule, your next appointment will be billed at the full price to ensure your home receives the necessary maintenance. Should you wish to cancel an upcoming appointment, please notify us at least twenty-four hours in advance at no extra charge. We do not offer rescheduling for recurring subscription services.
SUPPLIES & EQUIPMENT
Maid Of New York takes pride in offering eco-friendly cleaning supplies and equipment. If you prefer us to use your own chemicals and/or equipment, please inform us. However, please be aware that Maid Of New York management and the team cannot be held responsible for any equipment malfunction or property damage resulting from the use of your personal equipment, supplies, or chemicals.
As part of our standard policy, our team refrains from using bleach or bleaching agents. If you request, instruct, or provide any bleach, bleaching agent, or other unapproved chemical for use, you acknowledge that neither Maid Of New York management, the team, nor the insurance provider will be held liable for any harm, damage, or claims resulting from its use.
Furthermore, while the team will make every effort to accommodate the use of someone else’s equipment and supplies, management cannot guarantee the quality of the cleaning service in such cases.
DAMAGES OR BREAKAGES
While every Maid Of New York team is extensively trained to exercise the utmost care and caution when cleaning, occasional accidents may still occur. In the event of damage or breakage, our employees are required to complete an “Accident Report.” Following this, a member of our management team will reach out to you. It’s important to note that there are instances where breakages happen due to “booby-trapped” conditions, which are accidental breakages waiting to occur. Examples of such conditions include poorly secured pictures, top-heavy items with unstable bases, wobbly objects, and previously damaged or fragile items.
Under these circumstances, Maid Of New York cannot assume responsibility for accidents resulting from “booby-trapped” conditions. Additionally, it’s essential to understand that antiques, irreplaceable one-of-a-kind, and hard-to-find items are not covered by our insurance carrier’s breakage and loss policy. Consequently, in the event of damage or breakage, the cost of repair or replacement is not covered or reimbursable.
DENIAL OF PAYMENT, CHARGE-BACKS, AND LATE FEES
Customers who attempt to reverse payment to Maid Of New York, Inc. through a deliberate charge-back on their card will incur a $99 “denial-of-payment” fee, as well as all relevant late payment penalties, interest, administrative fees, and collection costs. Late payment penalties are structured as follows: $69 for account balances outstanding seven days after the service date, with an additional $79 if the balance remains outstanding thirty days after the service date.
Regardless of any personal, financial, or service-related circumstances prompting the termination or temporary suspension of services provided by Maid Of New York, you are still obligated to settle all outstanding payments for the time and labor previously provided. The terms and conditions of our agreement will remain in full effect until all account balances have been cleared. Failure to remit any owed funds will result in applicable fees, penalties, fines, and potential legal action as stipulated by the terms and conditions of our agreement. You will be solely responsible for covering any court, attorney(s), administration, collection, and/or arbitration costs incurred by Maid Of New York.
SOLICITATION OF EMPLOYEES
Upon being hired, employees of Maid Of New York are required to sign a non-compete agreement, which prohibits them from providing any services to past, present, or potential clients within our current service coverage area, both during their employment and for one year following their departure or dismissal. Clients are also required to agree not to solicit, entice, or influence any current or former employee who is still bound by their non-compete agreement to provide services, directly or indirectly, either individually or through a family member or another entity. Failure to comply with this provision will result in a $6,500 finder’s fee being assessed against their account, payable within 30 days of the assessment.
In the event that a client wishes to hire one of our current or former employees who is still contractually obligated by their non-compete agreement, we are willing to release them from their contract upon payment of a $3,500 referral fee, which will be billed to the client’s account.
All communications between you and Maid Of New York will be conducted electronically. This includes visiting our website, sending emails or text messages, receiving notices posted on our website, and communicating via email or text message. By engaging with us, you agree to (a) receive communications from Maid Of New York in electronic form for contractual purposes and (b) acknowledge that all terms and conditions, agreements, notices, disclosures, and other communications provided to you electronically by Maid Of New York fulfill any legal requirements as if they were in writing. This does not affect your non-waivable rights.
In the event that any provision of this agreement is deemed invalid or unenforceable for any reason, the remaining provisions will remain unaffected, and the problematic provision will be adjusted to the maximum extent permitted by law in order to be valid and enforceable. Without prior written consent from Maid Of New York, you may not assign any of your rights or delegate any of your duties under this agreement to a third party, whether by operation of law or otherwise. Any such assignment, delegation, or transfer made in violation of this requirement will be considered null and void.
